Please read these terms carefully — especially section 13, which covers how disputes are resolved. You accept them when you create your account in the app.
Please read section 13 carefully. It contains an agreement to resolve disputes by individual binding arbitration rather than in court, and a waiver of class actions and jury trials. You can opt out of it within 30 days — section 13 explains how. If you live in the EEA, the UK or Switzerland, section 13 does not apply to you.
These Terms of Use ("Terms") are a binding agreement between you and Calibra Technologies LLC, a Wyoming limited liability company at 1914 Thomes Ave, Ste 2, #3012, Cheyenne, WY 82001, United States, that owns and operates Apart ("Apart", "we", "us", "our"). They govern your use of the Apart website, mobile applications, content, and related services (together, the "Service").
You accept these Terms and our Privacy Policy when you create your Apart account, on the sign-up screen, which says so and links to both directly beneath the button. The app records the date and the version you accepted. If you do not agree, do not create an account.
Health-data consent. Outside the EEA, the UK and Switzerland, creating an account also needs your separate, explicit consent to Apart storing your health information in your account and using it as described in the Privacy Policy and our Consumer Health Data Privacy Policy, including sending it to its AI provider when you use an AI feature. The sign-up screen asks for it with its own box, unticked until you tick it; no account can be created without it, because Apart's program depends on it. You can withdraw that consent at any time in Settings → AI features & your data; doing so deletes your account and all of its data, because Apart cannot provide the program without it.
The Service does not provide medical advice, diagnosis, or treatment, and no part of it creates a doctor–patient or other professional relationship. Everything in the Service — including food lists, histamine estimates, timing windows, program phases, recipes, forecasts, pattern summaries, ratings such as "fits your plan", and responses from Apart Coach — is general wellness information provided for educational purposes only. Apart Coach is an AI, not a dietitian, nutritionist, or doctor.
Always consult a qualified healthcare professional before starting this or any diet, exercise, or wellness program, before making decisions about a medical condition, and before changing any treatment or medication. Never disregard or delay seeking professional medical advice because of something you read or received in the Service. If you experience a severe reaction — including signs of anaphylaxis — call emergency services immediately; do not rely on the Service.
Who Apart is not for. The Service is not intended for anyone who is under 18, pregnant or breastfeeding, or who has or has had an eating disorder, and the app asks about these before building a plan. It is not designed to detect, manage, or treat allergies, coeliac disease, mast-cell disorders, or any other medical condition. If a doctor manages a condition of yours with diet or medication, check the program with them before you start.
Dietary change carries inherent risk, and every body responds differently. You use the Service voluntarily. To the maximum extent permitted by law, you are responsible for your own dietary and lifestyle choices and for the risks that come with them, including adverse reactions, symptoms, weight change, or nutritional deficiency. Nothing in this section limits liability that the law does not allow to be limited, including for our gross negligence or wilful misconduct.
We make no promise that the Service will produce any particular result, including weight loss or symptom improvement. Individual results vary widely, and many people will see no results at all. Example screens, demonstrations, and advertising may show illustrative or simulated data rather than a real person's results.
Food data in the Service — histamine values, "bucket" units, macro figures, freshness estimates, glycemic data, and every derived score or forecast — are estimates and approximations. Apart's histamine units are its own scale, not milligrams. Histamine content in particular varies enormously with storage, preparation, ripeness, and batch. Always check product labels, and ask restaurant staff about anything you are allergic to.
You must be at least 18 years old to use the Service. You are responsible for the accuracy of the information you provide and for all activity on your device.
Your account. Outside the EEA, the UK and Switzerland you use Apart through an account, made with an email address and password or with Sign in with Apple or Google. Your program is synced to your account, so you can log in on another phone and pick up where you left off. Keep your sign-in details safe and give accurate information; you are responsible for what is done with your account, and you can delete it at any time in Settings → Delete all my data, which erases it and its data from our servers. We cannot recover an account after it is deleted.
EEA, UK and Switzerland. There your profile lives only on your phone. We hold no account for you and cannot see, recover, reset or restore your data: if you delete the app, change phone, or lose your device without a backup, your program history is gone permanently. Keeping a device backup is your responsibility.
If you got Apart from an App Store or Google Play storefront in the European Economic Area, the United Kingdom, or Switzerland, the app runs entirely on your device: AI features (photo, receipt and menu scanning, the AI coach, and other server-based features) are not available, and nothing about you is sent to our servers. The rest of the program works in full.
The free launch. Apart is currently free while we launch. We will announce the end of the launch period in the app and on this page before it happens.
Founding members. If you start using Apart while the launch is running, you are a founding member, and we promise you the following:
Your founding membership is recorded on your device (and in your device backup) and, once you use an AI feature, on our server against your installation's random identifier. If you lose it — for example by deleting the app without a backup — email support@eatapart.com and we will restore it where we reasonably can, for example with an App Store or Google Play promotional code.
AI capacity. AI features are subject to fair-use limits and to an overall daily capacity. On a day when capacity is reached, AI features may be unavailable until the next day; everything else keeps working, and the coach answers from its on-device engine.
Paid plans, once the launch ends. New members who join after the launch will see the price before paying anything. We expect to offer:
Payment and refunds. All payments are taken by Apple or Google, who are the sellers of record; we never receive your card details. Refunds are requested from them under their policies — in the app, through Settings → Profile & membership. We will help where we can. None of this limits any right you have under consumer law where you live, including any right of withdrawal or cancellation.
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use. You may not copy, scrape, resell, reverse-engineer, or redistribute any part of the Service (including the food database), use it to build a competing product, extract or misuse the app's credentials, interfere with its operation, or use it in any unlawful way. All content, software, branding, and data in the Service belong to Apart or its licensors.
You keep ownership of the content you submit (logs, photos, notes, custom recipes). You grant us a limited license to process that content only as needed to provide the features you use — for example, to send a photo you scan to our AI provider and return the result. We do not keep it afterwards, and we never use it to train AI models (see the Privacy Policy). You must have the right to submit what you submit.
The Service depends on third parties: the Apple App Store and Google Play for distribution and payment, Supabase for accounts, Netlify and Vercel for hosting, Anthropic for the Claude AI models behind the coach and the scanning features, Upstash for usage counters, and the Open Food Facts database for barcode lookups. We are not responsible for their acts, omissions, outages, or terms. What is sent to each of them, and when, is set out in our Privacy Policy.
Apart Coach, photo and receipt and menu scanning, meal-plan generation, and pattern analysis are powered by AI models. They can be confidently wrong. Identifications, portion estimates, histamine values, ratings, and any pattern or trigger Apart reports are generated from limited information and are not verified by a human or by a clinician. A rating such as "fits your plan" means a dish appears to follow the program's rules — it is never a statement that a food is free of an allergen or of gluten. Do not rely on AI features to avoid an allergen or to manage a diagnosed condition.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, APART DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY DATA OR OUTPUT WILL BE ACCURATE OR COMPLETE. Some jurisdictions do not allow these exclusions, so some of them may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) APART AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE; AND (b) APART'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR ONE HUNDRED US DOLLARS (USD $100).
Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, for gross negligence or wilful misconduct, or any other liability that cannot lawfully be excluded or limited where you live.
Talk to us first. Before starting any claim, you agree to send a written notice to support@eatapart.com with your name, how to reach you, what the dispute is about, and what you want, and to try to resolve it with us informally for 60 days. We will do the same before starting a claim against you. Time limits for bringing a claim are paused during those 60 days.
Agreement to arbitrate. If we cannot resolve it informally, you and we agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (a "Dispute") will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, available at adr.org. The Federal Arbitration Act governs this agreement to arbitrate. The arbitrator, not a court, decides questions about the scope, enforceability, and arbitrability of this section, except that a court decides the enforceability of the class-action waiver and the batch procedure below.
Class-action and jury waiver. You and we each may bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may award relief only to the individual party seeking it. You and we waive any right to a jury trial. If this waiver is found unenforceable for a particular claim or remedy (such as public injunctive relief), that claim or remedy will be decided by a court, not in arbitration, after the individual arbitration has finished — and it will never be arbitrated on a class basis.
Opting out. You can reject this section by emailing support@eatapart.com within 30 days of first accepting these Terms, with the subject "Arbitration opt-out" and the name you use in the app. Opting out does not affect anything else in these Terms.
Governing law and courts. These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules, except that the Federal Arbitration Act governs section 13. Any Dispute that is not arbitrated will be heard in the state or federal courts located in Wyoming, or in the courts where you live if the law gives you that right. Changes to this section 13 do not apply to a Dispute that either of us has already given notice of.
EEA, UK and Switzerland. If you live in the EEA, the UK or Switzerland, this section 13 does not apply to you: you may bring a claim in the courts where you live, and the consumer laws of your country continue to protect you.
You may stop using the Service at any time; Settings → Delete all my data (or withdrawing your health-data consent) deletes your account and its data from our servers, and everything Apart holds on your device. We may suspend or end your access if you breach these Terms, abuse or try to defraud the Service, if the law requires it, or if we discontinue the Service. Sections 02–04 and 10–13 survive termination.
We may change or discontinue parts of the Service, but we will not take away what we have promised founding members in section 06 while we operate it. We may update these Terms; the "Last updated" date above will change, and material changes will be shown in the app before they take effect. Continuing to use the Service after that means you accept them.
If you got the app from the Apple App Store: these Terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and — to the extent the law allows — has no other warranty obligation for it; if the app fails to conform to an applicable warranty, you may notify Apple, which may refund the purchase price (if any). We, not Apple, are responsible for handling any claims about the app, including product-liability claims, claims that it fails to meet a legal or regulatory requirement, consumer-protection or privacy claims, and claims that it infringes someone's intellectual property. You confirm you are not located in a country subject to a US Government embargo or designated as "terrorist supporting", and are not on any US Government list of prohibited or restricted parties. You must comply with any third-party terms (such as your mobile carrier's) when using the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. The license in section 07 is limited to Apple-branded devices you own or control, as the App Store's Usage Rules allow. If you got the app from Google Play, Google Play's terms also apply to your use of the store and payments.
These Terms are the entire agreement between you and Apart about the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor that takes over the Service, along with our promises to founding members.
